DMCA Copyright Policy for Fybos.com

Fybos.com (“we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Fybos.com website and associated services (the “Site”) that are reported to our designated Copyright Agent, identified below.

1. Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner, or authorized to act on behalf of one, and believe that your work has been copied in a way that constitutes copyright infringement on our Site, please submit a notice of alleged infringement (“DMCA Takedown Notice”) to our designated Copyright Agent containing the following information:

a. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
b. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
c. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. This must include specific URLs or other details to identify the allegedly infringing content on Fybos.com.
d. Your contact information, including your address, telephone number, and an email address.
e. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
f. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Designated Copyright Agent

Note: Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

3. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may send us a counter-notification (“Counter-Notice”) pursuant to Sections 512(g)(2) and (3) of the DMCA.

Your Counter-Notice must include:

a. Your physical or electronic signature.
b. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
c. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
d. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid Counter-Notice, we will forward it to the original complainant who submitted the DMCA Takedown Notice. The complainant will then have 10 business days to notify us that they have filed a court action seeking a court order to restrain you from engaging in infringing activity related to the removed content. If we do not receive such notification, we may, in our sole discretion, replace or restore access to the removed content.

4. Repeat Infringers

It is our policy to disable and/or terminate the accounts of users who are repeat infringers of copyright. We will make reasonable efforts to identify and terminate repeat infringers under appropriate circumstances.
